Welcome to creativefrenzy.in! These Terms of Service (“Terms”) govern your access to and use of the Influlance platform, owned and operated by Creative frenzy Pvt Ltd. By accessing or using our services, you agree to these Terms. If you do not agree, please do not use our platform.

1. Acceptance of Terms

By using creativefrenzy.in (“the Platform”), you acknowledge that you have read, understood, and agree to be bound by these Terms and any other applicable laws or regulations.

2. Services Offered

creativefrenzy.in is a platform that allows creativefrenzy and brands/employers to connect, collaborate, and work together. Our services include:

Facilitating communication between creativefrenzy and brands/employers.
Providing a secure payment gateway for transactions between users (powered by Razorpay).
Offering dispute resolution mechanisms for conflicts that may arise during collaborations.

3. User Accounts

To access the Platform’s services, you must register for an account. By creating an account:

You confirm that all information you provide is accurate and up-to-date.
You agree to keep your login credentials secure and confidential.
You agree not to share your account with others or impersonate another person.

creativefrenzy.in reserves the right to terminate any account that violates these Terms or is found to contain false information.

4. User Obligations

As a user of creativefrenzy.in, you agree:

Not to use the Platform for any illegal activities or in violation of any local, state, national, or international laws.
To comply with all rules regarding projects and collaborations.
To not post or share any harmful, defamatory, obscene, or misleading content.
To respect the rights and privacy of other users, including creativefrenzy and brands/employers.
To honor the terms of any agreements made on the Platform, including payments and deliverables.

5. Payment Terms

Payments on creativefrenzy.in are handled securely through Razorpay. By using our payment system, you agree to the following:

Escrow Payments: Payments made for projects are held in escrow until both the influencer and brand/employer confirm the project is completed.
Commission: creativefrenzy.in takes a commission on transactions between creativefrenzy and brands/employers. The commission is set at [X]% for creativefrenzy and [X]% for brands/employers.
Payment Processing: All payments must be made through the Platform. Users must not engage in any off-platform payments.
Withdrawal Limits: creativefrenzy must meet the minimum withdrawal amount of ₹100 to process payments from their accounts.

6. Refund and Cancellation Policy

Refunds: If a project is not completed as agreed or a dispute arises, the Platform will assist in refund processing. All refund requests must follow the guidelines set out in our Refund and Cancellation Policy.
Cancellations: Either party may cancel a project before work begins, and any payments held in escrow will be refunded accordingly. Once work has begun, the terms of the agreement must be followed.

7. Dispute Resolution

creativefrenzy.in offers dispute resolution services to help resolve conflicts between creativefrenzy and brands/employers. If a dispute arises:

Both parties must submit their claims and evidence to the Platform.
The Platform will mediate and propose a solution based on the evidence and communication between the parties.
Decisions made by the Platform’s dispute resolution team are final.

8. Content Ownership

User-Generated Content: creativefrenzy and brands/employers are responsible for the content they create and share on the Platform. You grant creativefrenzy.in a non-exclusive, royalty-free, worldwide license to use, display, and promote your content as necessary to provide the Platform’s services.
Intellectual Property: All materials provided by creativefrenzy or brands/employers remain the intellectual property of the respective party unless otherwise agreed upon in writing.

9. Termination

creativefrenzy.in reserves the right to suspend or terminate any account at our discretion if a user violates these Terms or engages in conduct that could harm the Platform or other users. You may also terminate your account at any time by contacting [email protected].

10. Limitation of Liability

To the maximum extent permitted by law, creativefrenzy.in, its owners, and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising from:

Your use or inability to use the Platform.
Any unauthorized access to or use of our servers and personal information.
Any content obtained from the Platform or interactions with other users.

11. Indemnification

You agree to indemnify and hold harmless Creative frenzy Pvt Ltd, its owners, employees, and affiliates from any claims, damages, liabilities, and expenses arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

12. Changes to These Terms

creativefrenzy.in reserves the right to modify these Terms at any time. We will notify users of significant changes by posting a notice on our Platform. Continued use of the Platform after changes are posted constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these Terms will be subject to the exclusive jurisdiction of the courts of Noida,(Uttar Pradesh) India.
